Mistrial declared in accused Santa Fe child rapist case

SANTA FE (KRQE) – A judge has declared a mistrial in the case of an accused child rapist after it was discovered two of his cousins may have made it on the jury.
Benny Delgado is accused of raping a 13-year-old girl.
A jury was seated on Monday.
That night, deputies say Delgado made a phone call from jail to relatives saying two of his first cousins were on the jury. Jail employees were quick to notify prosecutors, who say all jurors were asked twice if they know or were related to Delgado
