APD faces lawsuit after man claims he was unlawfully arrested

ALBUQUERQUE (KRQE)– The Albuquerque Police Department is facing a new lawsuit, this time from a man who claims he was unlawfully arrested after a medical episode.
Gary Martinez was arrested for suspicion of DWI while on his way to work.
Martinez had an ignition interlock device on his car and claims the officer presumed he was drunk when he was in fact suffering from a medical episode and had lost consciousness.
He also claims the officer refused to allow first responders to examine him.Th
